The website provides a convenient platform for ordering and purchasing local and international calling cards, recharging airtime for all companies, and purchasing SIM cards (the "Products"). In addition, you can find on the website information about the products offered for purchase on it.
1. Use of the website:
1.1. These Regulations and Terms of Use constitute a binding agreement between you, whether privately or through a corporation ("you") and the website with regards to browsing and using the website on any computer or other telecommunication device such as a cell phone, tablet devices, etc. They also apply to the use of the website and/or any related websites through an application or any other means. Read these Regulations and Terms of Use carefully, as browsing the website and performing actions on it is indicative of your consent to the conditions contained in these Regulations and Terms of Use ("the Regulations").
1.2. The provisions of these Regulations refer equally to members of both genders and the use of masculine and/or feminine language is for convenience purposes only.
1.3. Browsing the website is allowed at any age. Making purchases on the website is intended for people of legal capacity over the age of 18 only. A purchase by a minor under the age of 18 on the website requires the approval of a parent or guardian.
1.4. As a rule, visiting and browsing the website does not require registration, and it is open to anyone. Without derogating from the above, the website reserves the right to deny any user who has not registered to the website access to certain services on the website, for any reason or explanations, at its sole discretion, without the need for prior notice or warning and without being responsible for any damage caused due to its decision.

2. User Statements:
2.1. Prior to using the website, users and customers of the website state, affirm and agree that they know:
2.1.1. The prices offered on the website are completely different from the prices offered in stores operated by the company under the TOPSIM name or any other name or brand operating under the Company. The Company reserves the right to set different prices, and offer discounts and/or benefits for purchases on the website and/or in the store, at its sole discretion, and is not obligated to grant them to buyers on the website or in the store.
2.1.2. The Company and/or the website is not responsible for the communication and operation of the products, and the customers of the website confirm and declare that they are aware of this and that they shall be responsible for contacting the various telecommunication companies regarding any malfunction and/or problem related to the communication and operation of the products.
2.1.3. The website's customers confirm that they are aware of the fact that the Company and/or the website does not provide and/or operate the telecommunication services but is merely a distributor and therefore does not and will not have any responsibility for the operation of the products and/or the provision of telecommunication services, provided by various third parties, and they must contact the manufacturer and/or the telecommunication carrier regarding any malfunction or service interruption.
2.1.4. That the contents and information presented on the website are given and provided for the sake of information and education only and any subsequent action by you is under the user's responsibility;
2.1.5. That the information and contents are not presented as a substitute for professional advice, and should not be considered advice from professionals in the field of telecommunication and cellular communication and/or other professionals;
2.1.6. Any action you take as a result of using the content displayed on the website should be done with caution and the sole responsibility for any damages (if any), of any kind, shall be borne by the user of the content only, including leaving contact information with the service providers listed on the website.
2.1.7. That the customers of the website will not have any claim against the website, its managers, employees, affiliates, or anyone on its behalf and they will not be responsible, directly or indirectly, for any damage to the body, property or any other damage or any other loss, which will be caused as a result of receiving content and / or information from the website and / or from the website's services, even if the website warned, recommended or advised about a certain matter or a certain service, and in no event shall the website constitute a substitute or bear the responsibility of the customer and / or the recipient of the service. Also, the website does not provide the services and/or products that are advertised on the website but only serves as an online platform mediating between them.
2.1.10. The Website may collect a fee from third parties for a review and/or recommendation and/or product review and/or services provided by third parties advertised on the Website.
2.1.11. The website may receive compensation from any third parties for advertising products and/or services on the website and/or for collaborations with third parties on the website, among other things for sales made through purchase links on third-party sites.
2.1.12. It is the User's responsibility to verify and accept the Terms of Purchase, the Cancellation & Return policy, etc. of the service providers (telecommunications companies).
2.2. When browsing the website, you undertake and declare as follows: (1) browsing the website and using it are your sole responsibility; (2) the information you provided on the website is correct, current, accurate, and complete; (3) if necessary, in the event of any change in your information, you will update it by contacting the website; (4) you are legally competent and you agree to the terms of the Regulations; (5) you shall not use the website by automated or non-human means, whether through a BOT, script or in any other way; (6) you shall not make illegal use of the website; (7) your use of the website will not violate any applicable laws or regulations.

7.1. We reserve the right to: (1) observe violations of these Terms; (2) take legal action against anyone who violates the provisions of the law or the provisions of these Regulations, at the sole discretion of the Website, including, without limitation, reporting the user to law enforcement authorities; (3) refuse, restrict access, limit availability, or disable (to the extent technologically possible) any of your contributions to the Website or any part thereof, at the sole discretion of the Website and without limitation; and (4) manage the Website in a manner that shall protect its rights and property and facilitate its proper functioning.
8. Authorization for mailing, publications and advertisement:
8.1. A User who has left details on the Website and is added to the Website's mailing list, approves the use of their information for the purpose of receiving marketing information, updates and advertisements issued by the Website from time to time.
8.2. The mailing provisions described in the Regulations below shall apply to a user who left such information.
8.3. It is prohibited to submit the information of another person on the Website without their consent and/or without them being present in front of the screen when providing the information and after all the terms of the Regulations have been explained to them.
8.4. When submitting the information, the user will be asked to provide personal details such as: first name, last name, and telephone number as well as an active e-mail address (at the sole discretion of the website). 8.10.5. The information sent via the mailing list should not be considered a promise of any result and/or warranty for the product and/or service offered therein.
8.11. The Website shall not be liable for any damage (direct or indirect), loss, grief and expenses caused to the individual providing details and/or to any third parties as a result of using or relying on any content, information, data, presentation, advertisement, product, service, etc. sent via mailing. Any such reliance is made at the sole discretion and responsibility of the person providing the information.

9. Termination:
9.1. The terms of these Regulations will remain in effect when using the Website. Without derogating from any other provision herein, the website reserves the right to deny any user the usage of the Website (including blocking certain IP addresses), for any reason or reasoning whatsoever (without having to provide a reason or reasoning), at its sole discretion, without the need for prior notification or warning, for any reason or explanations, at its sole discretion, without the need for prior notice or warning and without being responsible for any damage caused due to its decision. Furthermore, the Website may terminate your use of it and any content or information you have posted at any time, without prior warning.
10. Changes, malfunctions & service interruptions o the Website:
10.1. The Website reserves the right to change or remove the Website content from time to time, for any reason, at its sole discretion and without prior notice. The Website is not obligated to update any information or content on the Website.
10.2. The Website shall not be liable to you or any third party for such change, suspension or discontinuance of service.
10.3. The Website does not guarantee that the Website's services will not be interrupted, provided regularly or without interruptions, conducted safely and without errors be immune to unauthorized access to the Website's computers or to damages, breakdowns, malfunctions or failures - all in hardware, software, lines and communication systems at the site or at any of its suppliers.
10.4. The Website reserves the right to change, at any time and without prior notice, the terms and conditions in these Regulations that apply to the use of the Website, and these changes shall enter into force immediately upon their inclusion in the Regulations.
11. Purchasing on the Website:
11.1. Prices, availability and other purchase conditions are presented on the website pages and may change from time to time. The Website reserves the right to change the range of products and/or services or to discontinue them or to change the price of the products and/or services offered on and off the Website, without prior notice.
11.2. The prices offered on the website are completely different from the prices offered in stores operated by the company under the TOPSIM name or any other name or brand operating under the Company. The Company reserves the right to set different prices, and offer discounts and/or benefits for purchases on the website and/or in the store, at its sole discretion, and is not obligated to grant them to buyers on the website or in the store.
11.3. When placing an order on the Website, you are responsible for providing correct, accurate, current and complete information. The Website may verify the details entered after placing an order, and may cancel or limit the order at any time. If a payment was made for an order was canceled, the Website will return the amount paid to the same payment method.
11.4. If, for any reason, the credit card company refuses to transfer the amount of payment for a purchase on the Website, the Website shall be entitled to suspend or immediately stop providing the service and it is entitled to demand the payment be made by other means plus the cost incurred by the Website due to the refusal (including fines from a third party), at the sole discretion of the Website. If the Website is forced to resort to legal proceedings in order to collect payment balances, you undertake to indemnify the Website for all expenses incurred, including attorney's fees and other legal expenses.
11.5. Purchasing on the website is subject to additional terms and conditions made by the credit companies and any other means of payment specified on the website.
12. Supply Policy:
12.1. Charging airtime will be possible online. After the purchase, the buyer will get access to the product they purchased on the Website.
12.2. The Website will ensure the delivery of an order placed on the Website to any place agreed upon by the parties at the time of placing the order on the Website.
12.3. SIM card orders placed on the Website will be processed and delivered in the following schedules:
12.3.1. Up to 3 business days by express courier to your home;
12.3.2. Up to 5 business days by a courier to your home;
12.3.3. Up to 7 business days by a registered mail;
"Business day" - Sundays through Thursdays, excluding national Sabbaths, holiday eves and days when banks in Israel are closed.
12.4. The prices on the Website do not include the shipping cost. The shipping cost may be updated from time to time, as shall be stated on the Website at the time of placing the order.
12.5. The Website may set a minimum amount for orders on the Website.
12.6. If a product ordered on the website is not available in stock, the Website will inform the customer. If the person placing the order is not available, the Website shall send the order without the missing product.
12.7. If the customer is not at home when the courier arrives within the time agreed upon in advance, the order shall be returned and sent once more after payment of additional shipping fees by the customer.
12.8. Orders may be delivered throughout the country, subject to the following conditions:
12.8.1. There is a reasonable access to the place of order;
12.8.2. The Website (including its courier company) carries out deliveries in the that area;
12.8.3. If it is an organization, institution, kibbutz or settlement that cannot be reached without special permission and/or there is no organized registration of streets and/or house numbers, the order will be delivered to the central distribution point in that place.
12.9. The Website will not be liable for any delay in delivery and/or non-delivery, which will result from:
12.9.1. Force majeure and/or events beyond the control of the Website;
12.9.2. Due to reasons related to the Israel Post Service/the Website's courier company;
12.10. A general shutdown of the economy that affects the activity of the site and/or its suppliers and/or service providers, for any reason.
13. Orders Refund, Change and Cancellation Policy:
13.1. Any request for a refund, change or cancellation of a transaction will be sent to the Website using one of the means of communication listed at the end of these Regulations.
13.2. Due to the nature of the service, changing and/or canceling the purchase of products will not be possible after purchasing them and gaining access to them and the buyer will not be entitled to any refund.
13.3. A refund, change or cancellation of empty SIM cards orders only, shall be possible with a refund or exchange within a period of up to 14 days after the customer receives the order.
13.4. The refund will be made using the payment method the customer used when placing the order.
13.5. If the refund, change or cancellation is requested after 14 days of receiving the order, a request for a refund, change or cancellation of a transaction will be possible subject to the Website's sole discretion.
13.6. Refund, change or cancellation will be approved after the customer receives a written notification from the Website confirming this.
13.7. If a refund, change or cancellation was made because the customer regretted their purchase (and not due to a defect or discrepancy) and was approved by the Website:
13.7.1. The customer must return the product to the site in its original packaging and the same condition as they received it;
13.7.2. The product packaging has not been opened and the product has not been used in any way;
13.7.3. The product shall be returned together with the invoice of the transaction or proof of purchase;
13.7.4. The costs associated with returning the order shall apply to the customer;
13.7.5. A cancellation fee of 5% of the product amount or NIS 100 (whichever is lower) will be charged.
13.8. If a refund, change or cancellation is made due to a defect in the product, the responsibility for collecting or replacing the defective product from the place of delivery will apply to the Website.
13.9. A product defined as defective by the customer will be inspected by the Website. If, after inspection by the Website, the product is found to be in good condition and/or the defect was created after the customer received the product as a result of unreasonable use, the customer will not receive a refund and will be able to request the product be sent back to them subject to additional payment of shipping fees.
13.10. The provisions of these Regulations are subject to the provisions of the Consumer Protection Law, 5741-1981.
14. Jurisdiction:
14.1. These Regulations and the use of the Website shall be exclusively governed by the laws of the State of Israel, but the international choice of law rules set forth therein shall not apply.
14.2. The courts in the jurisdiction of the District Court in the Center District shall have exclusive jurisdiction in all matters arising from and/or related to these Regulations and/or legal disputes that may arise between you and the Website.
15. Accuracy / technical and other corrections:
15.1. The Website as a whole, including all the information that appears in it, is offered as is, and shall be as accurate and correct as possible, however, the information may not be complete or there may be technical or other errors in the information. The Website reserves the right to correct mistakes and/or errors and/or inaccuracies as mentioned above and to update the information on the Website at any time and without prior notice.
16. The Website’s Responsibility:
16.1. The Website and/or the website is not responsible for the communication and operation of the products, and the customers of the website confirm and declare that they are aware of this and that they shall be responsible for contacting the various telecommunication companies regarding any malfunction and/or problem related to the communication and operation of the products.
16.2. The website's customers confirm that they are aware of the fact that the Website does not provide and/or operate the telecommunication services but is merely a distributor and therefore does not and will not have any responsibility for the operation of the products and/or the provision of telecommunication services, provided by various third parties, and they must contact the manufacturer and/or the telecommunication carrier regarding any malfunction or service interruption.
16.3. Relying on the contents and contracting with the service providers is under the customer's sole responsibility and the customer shall not have any claim against the website, its managers, employees, affiliates, or anyone on its behalf and they will not be responsible, directly or indirectly, for any damage to the body, property or any other damage or any other loss, which will be caused as a result of the use of content, information, product purchases, and services provided by the service, even if the website has warned, recommended or advised about a certain matter or a certain service, and in no event shall the website constitute a substitute or bear the responsibility of the user.
16.4. Information and presentations about the services on the Website, which originate from the service providers shall be the sole responsibility of the users of the website and are the sole responsibility of the aforementioned service providers, and therefore, it is clear that the Website has no responsibility for this kind of information, and the Website does not guaranty the accuracy of any such information.
16.5. The Website is not a party to the contract between the service providers advertised on the website and the users and it acts solely to connect between them. Also, the website does not provide the services provided by the service providers which contacted the ordering customers on the website for the purpose of receiving the services and serves as an online platform mediating between them.
16.6. The Website makes efforts to vet the service providers, businesses and professionals, at the same time, it should be emphasized and clarified that the Website shall not be obliged to do background checks for the service providers, business owners and professionals and that it cannot and will not be responsible for the information they publish and/or the service provided by them.
16.7. The information on the Website should not be considered a promise of any result and/or responsibility to the manner of activities of the products sold on it. The Website shall not be responsible for any damage, direct or indirect, that will be caused to the user as a result of relying on the information presented on the Website and/or links to other websites and/or any other internal and/or external source of information and/or use of products presented by it.
16.8. The contents on the Website can be used AS IS. They cannot be adapted to the needs of each and every person. The user shall not have any claim, assertion or demand against the Website regarding the features of the contents, their capabilities, limitations and/or their suitability to their needs and the use of the website shall be the sole responsibility of the Website user.

There may be certain differences in appearance, color, size, etc. between the product, as it is presented on the Website, and the product that will be delivered to the customer. A typo in the description of a product and/or its price shall not bind the Website.
16.10. The products presented on the Website are manufactured and/or imported and/or marketed and/or supplied by third parties. The Website's customers confirm and declare that they are aware of this and that they will bear the responsibility to contact and demand from the manufacturer and/or the importer and/or the marketer and/or the supplier compensation for any damage, direct or indirect, including bodily damage, incurred by them, which exceeds the cost of the product.

16.12. The use of the Website will be done at the sole and full responsibility of each user. 17. Indemnification:
17.1. The user must indemnify the Website, its employees, managers, business partners or anyone on their behalf for any damage, loss, loss of profit, payment or expense incurred by them - including attorney's fees and court costs due to the violation of these Regulations.
